1. Acceptance of Terms

By accessing or using KnucklePay (the "App" or "Service"), you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the App.

2. Eligibility

To use KnucklePay, you must:

• Be at least 18 years old;
• Be a legal resident of the U.S.;
• Provide valid identification and biometric data (fingerprint).

3. Account & User Responsibilities

• Keep your PIN confidential and secure—do not share it.
• You are responsible for activity on your account, including biometric-authorized transactions.
• Do not engage in fraudulent, illegal, or unauthorized activities (e.g. money laundering, terrorism financing).

4. Biometric Data & Privacy

• You grant KnucklePay permission to collect, store, and use your fingerprint data solely for authentication and transaction purposes, in compliance with U.S. biometrics laws (e.g. FTC standards).
• You may delete your account at any time, which also deletes your biometric data.

5. Fees & Transactions

• Applicable fees (e.g. transaction, cash-out, service fees) will be clearly disclosed prior to each transaction.
• You agree to pay all fees associated with your use of the Service.

6. Electronic Funds Transfer Compliance

Transactions are governed by U.S. Electronic Fund Transfers Act (EFTA) and Regulation E. KnucklePay—whether directly or through partners—will follow all EFT requirements, including error resolution.

7. Termination & Suspension

• KnucklePay may suspend or terminate your account access if you:
• Violate these Terms or applicable laws;
• Engage in suspected fraud or unauthorized use;
• Are requested to do so by regulators or law enforcement.

8. Dispute Resolution & Governing Law

• These Terms are governed by U.S. federal law and the laws of North Carolina.
• Any disputes will be resolved in federal or state courts located in Charlotte, NC, or arbitration if elected.

9. Limitation of Liability

• KnucklePay is not liable for unauthorized access or transactions caused by your negligence.
• We are not responsible for service interruptions or delays beyond our control.
• Except as required by law, KnucklePay's liability will be limited to actual damages only. We expressly disclaim liability for indirect, incidental, consequential, punitive, or special damages (e.g. lost profits).

10. Indemnification

You agree to indemnify and hold harmless KnucklePay, its officers, directors, employees, and agents from any claims, liabilities, expenses, losses, or damages (including reasonable attorneys' fees) arising from:

• Your use of the Service;
• Any violation of these Terms;
• Your negligence or willful misconduct.

11. Updates to Terms

KnucklePay may update these Terms at any time. Updates will be posted on the App or Website and notified to you. Continued use after updates means acceptance.

12. Severability

If any provision is invalid or unenforceable, that provision will be removed and the remaining Terms remain in force.
